1840, Report of the D'Hauteville Case
Report of the d’Hauteville Case: The Commonwealth of Pennsylvania, at the suggestion of Paul Daniel Gonsalve Grand d’Hauteville, versus Davis Sears,
Miriam C. Sears, and Ellen Sears Grand d’Hauteville. Habeas Corpus for the Custody of an Infant Child. Printed by William S. Martien (Philadelphia
1840). 295 p. This volume includes legal documents, exhibits, testimony of relator and respondent, arguments of counsel and the opinion and decree of the
court. The court ruled that the named infant, Frederick Sears Grand d’Hauteville, was not unlawfully restrained and should be remanded to his mother,
Ellen Sears Grand d’Hauteville. (A reviewer described this as “a high profile child custody case … which helped establish the precedent in American
courts of making the determination of custody based on what is in the best interests of the child, with a strong presumption that maternal custody is
best.”)
