Attorney General. Opinion on rail road in Charlestown and Cambridge, 1835
|

Senate No. 24 On February 10, 1835, the Senate asked the Attorney General if a proposed railroad interfered with any Commonwealth rights. On
February 17, 1835, the Attorney General said the "flats," an area potentially affected by the railroad, was owned by the Riparian Proprietors, of which the
Commonwealth was a member. A proposed bridge would cut off all access to the wharf of the State Prison. The prison warden sent several suggestions
to ameliorate the impact. The bridge and nearby track would have to be carefully designed and built. (Digitized from a microfilm copy of title

Title:
Ordered, that the Attorney General be directed to examine and report to this Board, whether the petition of Abijah Goodrich and others, for a rail-road in Charlestown and Cambridge, interferes with the rights of the Commonwealth in the flats in, over, or near which the same is proposed to be located; and also what rights the Commonwealth have to the flats which lie between the proposed road and the shore, and also between said road and the channel.
