Opinions of the Office of Legal Counsel of the United States Department of Justice; Consisting of selected memorandum opinions advising the President
of the United States, the Attorney General and other executive officers of the Federal Government in relation to their official duties: Vol. 1–,
1977–, Wash., GPO, 1978–, series continues. (Among his many duties the Attorney General represents the United States in legal matters generally and gives
advice and opinions to the President and to the heads of the executive departments of the Government when so requested. From 1791 to 1977, the
opinions of the Attorney General were reported in the series United States Attorney Generals’ Opinions, available on this site as LLMC. In 1977, under
statutory authority {28 U.S.C. § 510}, the A.G. delegated the responsibility for preparing the formal opinions of the A.G. to the Justice Department’s
Office of Legal Counsel. It is the decisions issued by the latter office under that delegated authority that are published in the present series. Although
it was delegated new responsibilities in 1977 as described above, the Office of Legal Counsel dates back to 1934, when it was established by the
Attorney General of the time, Homer Cummings, to advise the president, in his words, on “the more troublesome questions arising in the administration of
the executive branch of the Government.” It was subsequently staffed by some of the most influential constitutional lawyers of the twentieth century;
among them future Supreme Court justices William Rehnquist and Antonin Scalia, and the civil libertarian Thomas Emerson. Later in his career, while a
law professor at Yale, Emerson wrote the leading First Amendment treatise of his era, and successfully argued before the Supreme Court the landmark
right-to-privacy case, Griswold v. Connecticut, the predecessor to Roe v. Wade. Most of the opinions delivered to the Executive by the Office of Legal
Counsel prior to 1977 were unpublished, either for lack of funds or for prudential reasons of state. In 2013 the Justice Department began a retrospective
series that will publish selected opinions from the years 1934 to 1977. That supplemental title is offered on this site as LLMC Number 10142.)
