Gen. Assembly. Bill on apprehension of runaway slaves, 1846

|
1846 North Carolina General Assembly bill to provide for the apprehension of runaway slaves in the Great Dismal Swamp. This bill addressed a concern of surrounding plantations which experienced a number of runaway slaves into the swamp by enacting a comprehensive system of requirements and punishments. Initially, both slaves and free persons of color who worked in that area were required to go before the clerk of a court and have a description registered, presumably to aid in capture. Failure to do so on the part of the masters might result in a fine; failure by a free person of color would result in a "fine, imprisonment, and whipping, all or any of them." The same penalty was also enacted for registered free person of color found with a runaway in the swamp. In addition, the bill also provided for a reward for undocumented slaves found in the swamp, and 39 lashes for the unfortunate slave or for any registered slave found in his company. White persons would be subject to $100 fine and possibly imprisonment. Forgeries of documents were similarly punished.
