An article, Martial Law, by W. F. Finlason, which was reprinted from the "Law Magazine and Review," of May and June 1872 and published by Butterworths, and printed by Reap, Holt and Co. in London in 1872. This article appeared to be written following an incident in India in which the Deputy-Commissioner executed fifty insurrectionists without a trial allegedly under the exercise of martial law. The author then traced the history of martial law and the inherent distinctions between martial law precipitated by some act of rebellion and the normal application of civil law. He also rebutted some criticism of martial law, noting the the determination of its application is to be determined by the exigency of the situation at the time by the military leadership, and not review post rebellion. The author did, however, clarify that India represented an inappropriate use of martial law; that civilian leaders must follow the decisions of military leadership and not engage in excessive inhumanity or impropriety.
