Maxwell, Edie. Clemency review, 1918-1924
Clemency review file containing documents (1918-1924) related to the prosecution of Edie Maxwell, Company “M”, 24th Infantry, for disobedience of
orders, joining in a mutiny, murder of 14 persons and assault with intent to kill eight persons, related to the riots in Houston, Texas on August 23,
1917. Maxwell was found guilty of disobedience and mutiny, and not guilty of murder and assault, and sentenced to 15 years in prison (later reduced to 12
years and then 10 years). 55 p. Contents include Military Justice office letters denying requests for clemency; case review document (April 8, 1919,
signed by B. A. Read, Assistant to Judge Advocate General) stating that evidence was sufficient to support findings of the court; Clemency Review
document from War Department recommending against clemency (April 29, 1919); handwritten letter from Maxwell to Sen. James Wadsworth, Jr., and response
from Military Justice office (November 22, 1919); Military Justice office responses to Maxwell’s requests for clemency and inquiries from members of
Congress (1919-1922); letters by Maxwell to Senators and the Judge Advocate General; Military Justice office letter (September 27, 1922, signed by J. A.
Hull, Acting Judge Advocate General) stating that Maxwell’s sentence had been reduced to 12 years (from 15 years) and recommending the Attorney
General approve the findings of the Parole Board granting parole to Maxwell; and Military Justice office review (1924) acknowledging that Maxwell was
paroled and recommending no further grant of clemency.
