This opinion was issued under the authority of Caleb Cushing, diplomat, U.S. congressman, Massachusetts state judge, and U.S. Attorney General under Pres. Franklin Pierce from 1853-1857, The practice in question was British military recruitment on U.S. territory. Caleb’s opinion held that the practice was clearly illegal under U.S. law, and therefore that Great Britain’s consuls and other representatives in the U.S. had no standing to defend the practice in American courts.
