White and Sam A Willson, Vol. 1-4, 1876-92, St. Louis, The Gilbert Book Co., 1883-, all published. Cite as White & W. (Vol. 1 was by White and Willson. Vols. 2-4 were by White alone. A backlog of cases in the then designated Court of Appeals of Texas led to the creation by the legislature in 1879 of a court of “The Commissioners of Appeals of the State of Texas.” The commissioners were empowered to hear and decide cases when the parties had consented to a referral from the Supreme Court or the Court of Appeals. The law setting up the Commissioners’ Court did not provide for the reporting of their decisions. Hence the original need for this work. Later, in February 1881, the two courts were given the power to refer cases to the commissioners to relieve their backlogs regardless of the parties’ consent. The Commissioners Court was abolished in 1884, although the appeals docket backlogs persisted and eventually led to the creation of a separate Court of Civil Appeals.
