1796-1816, Smith's Reports
Decisions of the Superior and Supreme Courts of New Hampshire; From 1802 to 1809 & 1813 to 1816; Selected from the manuscript reports of the late
Jeremiah Smith, Chief justice of those courts; With extracts from Judge Smith's manuscript treatise on probate law, and from his other manuscripts: na,
xiv+574p, Boston, Little, Brown & Co., 1879, all publ. (These reports were compiled from Judge Smith's manuscripts long after his death. The compiler
is unknown, since even the preface is unsigned. Despite the apparent distinction in the title, all of these decisions are “Supreme Court” cases. Prior
to 1813 the highest judicial tribunal in the state was styled “The Superior Court of Judicature.” Thereafter it was officially styled “The Supreme
Judicial Court.” Both terms were used indiscriminately in the constitutions of the time. — See reporter's note at 53 NH 634. Also, despite the title,
some cases dating back to at least 1796, with written opinions of undisclosed provenance, are included in the text, although printed out of
chronological order; see, e.g., p. 298. For this reason LLMC joins with Price & Bitner's 5th ed. Appendix in giving the coverage dates as being 1796–1816. New
Hampshire cases were not compiled and published in reporters during the pre-statehood period.)
