1825-05-30, Opinion on rent payable to Hopkins' Trustees
SEE ALSO 51666, 51687 The House asked the Supreme Court's opinion on February 23, 1825 as to whether the State should deduct an amount from the
Hopkins tenants' land taxes to pay the required quit rent to the Hopkins Trust. This arrangement had been set up as a matter of convenience. In an
opinion delivered on May 30, 1825, the Court said, "No." This succinct answer was followed by several pages of explication. The Court said the
Legislature had unnecessarily involved itself in what was a contract between the Hopkins Trustees and the tenants and the Legislature should not feel obliged
to continue the arrangement. The House accepted the Court's opinion and declined to have the State continue in its tax collecting role. (Digitized

To the Honourable House of Representatives of the Commonwealth of Massachusetts : The justices of the Supreme Judicial Court having maturely considered the question proposed to them by an order of the House of 23d February, 1825, are of opinion that the Commonwealth is not under legal obligation to pay to the Trustees of the Hopkins' Donation the rent of the lands formerly held by said Trustees ... .
