1856-12-08, Louisiana vs. Harrison
|
|
December 8, 1856 decision of the Supreme Court of Louisiana in Louisiana v. Harrison. In that case, the court examined if the Act of 15th of March, 1855, entitled “ an Act relative to slaves and free colored persons,” was constitutional. The basis of the claim was because its title expressed two distinct groups: slaves and free colored persons, which the majority noted was "in the eye of the Louisiana law, there is, ... all the difference between a free man of color and a slave, that there is between a white man and a slave." Of note the law was found unconstitutional. (Digitized from a microfilm copy of titles originally held by the Library of Congress).
