When a company raises a head of water to support a mill and floods nearby land in the process, that landowner can get a jury assessment of damages and can either deed the land over to the mill company or receive a yearly payment for damages. In general, get permission for all water diversions across another's land.
H.R. No. 38 An Act in addition to the several acts for the support and regulation of mills, 1828. All water diversions had to be with the consent of the landowner. Juries can determine damages.
