Act for relief of poor debtors arrested for debt, 1826. Any debtor arrested could seek to be bailed out of confinement by swearing to the Justice of the Peace s/he could not afford the cost of prison. The debtor had to provide one or more sureties who would be liable for costs, fees, and damages if the debtor failed to come to court on time. The sureties would be released from their obligations once the court appearance was made. The debtor also had to swear s/he had not recently sold or hidden any asset. The creditors of said debtor were to be notified that the debtor was taking bail. If the debtor absconded and was caught, the debtor was no longer eligible for bail. All court proceedings were to be in writing and the Justices were to keep records. There were many fees due the justices for their time.
