Thirty-seventh Legislature. House. No. 2 An Act to amend Chapter 59 of the Revised Statutes relating to marriage and its solemnization, 1858. Various sections were changed to require couples to register their intent to marry with the local clerk, who would then provide a certificate of intent. Males had to be 21 and females 18 or else provide a statement from their parents. If couples went out of state or lied to the clerk to evade the requirements, the marriage was not legal and they could be fined $100.
