1862, Shaver, Brief for Claim, 1862
A brief in support of the a claim of John I. Shaver vs the United States before the Mixed Commission on British and American Claims, which was filed
on March 1, 1873. Mr. Shavers, a Canadian, filed suit following his arrest under orders of the Secretary of State Seward on October 19, 1861 and
imprisonment at Fort Lafayette until January 6, 1862. His arrest was based on the Seward's conclusion that Shavers was a U.S. citizen and not a Canadian
and ultimately this became an international issue. Ultimately Shavers was released, but this brief is to recover damages, which he claimed amounted
to over $100,000. The suit followed the 1871 Treaty of Washington, signed and ratified by the United Kingdom and the United States which settled
various disputes between the countries, including claims of British citizens during the Civil War.
