Roscoe's Prize Cases in Admiralty, 1745-1859, 2v
Reports of prize cases determined in the High Court of Admiralty, before the Lords Commissioners of Appeals in Prize Cases, and before the Judicial
Committee of the Privy Council from 1745-1859: ed. by E. S. Roscoe, Vol. 1-2, 1745-1859, London, Stevens & Sons, 1905, all published. (For lack of a
ready alternative, this title is grouped by LLMC, and authorities such as Price & Bitner, among the English “nominative reporters.” However, it differs
from most of the latter in both origin and character. In American law school parlance, a work of this nature would be classified as a “casebook”;
i.e., a compendium of extracts, some more complete than others, from the reports of cases illustrating a narrow area of law. The history of this work
dates back to a report from the Interdepartmental Committee of 1902 on Prize Law that flagged the need for a single edition of the more important Prize
Cases that were scattered throughout the numerous separate Admiralty Reports. Roscoe, a barrister then serving as Admiralty Registrar of the Supreme
Court, was charged with the task of authoring the compilation. His work reports in full the opinions in some of the more seminal cases, but relies on
short extracts of points-of-law-decided for many others. In general he omits purely Admiralty Cases, and also cases on the Navigation, Slave trade, and
Revenue Acts. Questions of facts are generally omitted, as are cases reiterative of points of practice. A Table of Reports {pp. xi-xii of Vol. 1}
lists those earlier works from which Roscoe’s examples were culled. Each volume has its own index and table of cases discussed.)
