Attorney General. Report relating to the Warren Bridge, 1835

Senate (Second Session) No. 2 Report of the Attorney General relating to Warren Bridge. On April 10, 1835, Attorney General Austin sent his opinion
to the Executive Council. He thought the issue revolved around legislative intent, so he focused on the statutes about the bridge. The bridge was
supposed to revert to state ownership at a set date, but there was no statute to say what to do with it. Public or private road? Toll or no toll?
Maintenance by? In 1833, the Legislature directed the Governor to take possession of the bridge on the appropriate day, take the tolls, and generally
manage the structure. However, if the Corporation wanted to give a bond, they could continue to manage the bridge and take tolls, some of which went
to the state. That happened, so the Warren Bridge Corporation was an agent of the state. By the end of the 1835 session, that arrangement would end.
There were many pages about when the session of the Legislature ended--at the end of the first or second session. The Attorney General voted for the
second session ending in October. Then the bridge had to revert to state management, but the executive branch had no power to do anything; a statute
