Forty-fifth Legislature. House. No. 53. The Joint Select Committee on Jury Trials submitted: An Act providing for jury trials before trial
justices and prescribing their mode of proceedings and jurisdiction, 1866. Trial justices had jurisdiction over civil cases for $50 or less. The defendant
could demand a jury trial by six men; there followed the procedure for empaneling a jury. If the jury could not reach a verdict, the judge could
decide or another jury could be called. The parties could also have the case heard by one or more referees. There were three situations wherein there
was no appeal, but there were directions for appeals that were allowed. There was information about court costs and a few forms. (Digitized from a
