Forty-fourth Legislature. Senate. No. 22. The Committee on the Judiciary submitted: An Act to simplify indictments in capital cases, 1865. It was not necessary to include the manner of death in an indictment. For murder "the defendant did feloniously, wilfully, and of his malice aforethought kill and murder the deceased." Use "kill and slay" for a manslaughter indictment.
