SEE ALSO 56093 Forty-third Legislature. House. No. 30. Five men of the Joint Select Committee on Capital Punishment submitted: An Act in addition to section seven of chapter one hundred thirty-five of the Revised Statutes relating to the execution of sentence in capital cases, 1864. As soon as the sentence was pronounced in a capital case, the record of the case was to be sent to the Governor. He had one year to set a date for execution, which had to take place more than one year after sentence. The sentence could be commuted or pardon issued in that time. The burden was on the Governor.
