Fortieth Legislature. House. No. 68. On March 11, 1861, the Committee on the Judiciary minority member submitted: An Act in relation to evidence, 1861. False statements, fraudulently made, could be proved by parole testimony. The aggrieved person could testify as a witness. The minority member argued vigorously that in common law, persons with an interest in a case were not allowed to testify, but that meant that some of the most pertinent evidence could not reach the judge or jurors.
