which relief can be granted. In 1988 the Judicial Conference Advisory Committee on Civil Rules was presented with a proposal to abolish the rule, on
grounds that it was being overused with the intent to delay cases and that it rarely lead to its intended goal, the disposition of at least some cases.
This study was commissioned to ascertain the factuality of those claims. On the basis of its conclusions the Committee decided not to recommend
abolition of the rule.)
