Contents include an Introduction; five sections: I, Opposing conceptions of the character of States and the Nature of the Process of Admissions; II, Historical and constitutional grounds for the support of both the territorial claim to admission and the Congressional claim to unlimited control over admissions; III, Historical review of the process of admission; IV, Analysis of the provisions of admitting acts in the following particulars: public lands, navigable rivers, interstate rights of U.S. citizens, public schools, right of suffrage, principles of civil and religious liberty, conditions under which the reconstructed States were restored; and V, The stipulation of treaties as affecting the individual’s claim to admission and foreign interference; and the Conclusion (territories viewed as embryo states; the question of admission of States is a political question).
