Senate No. 50 In February 1842, the Committee on the Judiciary, in response to an order, reported a bill: An Act relating to the surviving of
actions, 1842. An action of trespass damaging a person would survive; an administrator could prosecute or defend as required. When a motion for a new
trial for any cause was overruled, the rule had to be rendered to preserve the rights of the prevailing party and prevent loss by death of either
