House No. 20 On January 15, 1841, the Senate committee on the Judiciary was directed to consider repealing the divorce law of 1838. In February,
the committee reported: An Act relating to divorce, 1841. The act of 1838 was repealed, but pending proceeding were not affected. Then the House
Committee on the Judiciary weighed in with a long report on February 3, 1841. There was a brief history of divorce, the causes for divorce in other
states, and a recognition that the current system caused suffering. The Committee recommended expanding the legal causes for divorce and presented: An
Act relating to divorce, 1841. A divorce could be had for extreme cruelty or habitual drunkenness [constant intoxication for 3 years] The wife's
alimony or estate were treated the same as in a desertion claim. Then came a minority report that leaned very heavily on Christian scriptures that
proscribed divorce, mostly in the Old Testament. The minority thought divorce should be very difficult to obtain and recommended the original bill rather
