Senate. Act to defray expenses of the probate courts (with Senate amendments), 1841
Senate No. 54 [Senate amendments in italics] An Act to defray the expenses of the Probate Courts, 1841. Each estate coming under the Court's
jurisdiction would be assessed at the rate of 1/4 of 1% and upwards, based on the value of the estate after the debts were paid. The fee would be
deducted proportionately from each legatee's share. The amounts were to appear in the administrator's account. There were two ideas about how to get the
fee if the administrator defaulted. Trustees had to pay fees over the life of a trust. An amendment listed salaries for the Registers of Probate for
