Senate No. 48 On March 8, 1841, in response to an order, the Committee on Railways and Canals reported: An Act relating to rail-roads, 1841.
Whenever [county] commissioners were required to assess damages to private property caused by a railroad. they could forego money damages in favor of
construction of drains, culverts, walls, fences, etc. to prevent a recurrence of the problem. If the railroad were dilatory or failed to do the work at
all, the landowner could sue in the Supreme Judicial Court for double damages. (Digitized from a microfilm copy of title originally held by the

Title:   Ordered, that the Committee on Rail-roads and Canals inquire into the expediency of further provision by law, in relation to the liabilities of owners of cattle that may stray upon rail-road tracks, and also requiring rail-road corporations to errect and maintain such fixtures adjoining lands taken by them ... .
