Senate No. 24 On February 2, 1841, A Special Committee reported on the increased county balances. The Committee said the Attorney General had
reported, in 1839, that much of it was from billing the Commonwealth for court costs in various county courts. The Committee provided a history of the
practice going back to 1817. The men offered a bill: An Act relative to the costs and expenses of criminal prosecutions, 1841. Two-thirds of the cost
of criminal prosecutions would be paid by the Commonwealth unless one party to the prosecution had to pay. The remaining third would be paid by the
counties. County Treasurers could only bill for the two-thirds amount. (Digitized from a microfilm copy of title originally held by the Library of

Ordered, that Messrs. Hubbard, Allen, and Bates, be a committee to inquire in regard to the causes which have led to the increase of the amount of the county balances, and whether any reduction can be effected therein by legislative action.
