Senate. Comm. on the Judiciary. Report on property boundary lines, 1841
|
|
Senate No. 10 On January 22, 1841, the Committee on the Judiciary reported on the issue of fruit trees overhanging property lines and who owned what. There was no case law in Massachusetts, but quite a bit in other jurisdictions. The results were mixed and contradictory: "whoever owns the ground it is his to the sky," "owned where first planted." Or, it is wrong to let branches hang over, but one does not lose title to the fruit anymore than one loses title to a wandering cow. The Committee did not see a need for legislation. (Digitized from a microfilm copy of title originally held by the Library of Congress).
