Senate No. 10 On January 22, 1841, the Committee on the Judiciary reported on the issue of fruit trees overhanging property lines and who owned
what. There was no case law in Massachusetts, but quite a bit in other jurisdictions. The results were mixed and contradictory: "whoever owns the
ground it is his to the sky," "owned where first planted." Or, it is wrong to let branches hang over, but one does not lose title to the fruit anymore
than one loses title to a wandering cow. The Committee did not see a need for legislation. (Digitized from a microfilm copy of title originally held

Ordered, that the Committee on the Judiciary consider and report, whether any provision by law ought to be made in regard to the owners of adjacent lands, as to fruit and other trees standing near the boundary lines of such lands.
