House. Comm. on the Judiciary. Act concerning the Supreme Judicial Court and the Court of Common Pleas, 1840
House No. 59 The Committee on the Judiciary reported a bill: An Act concerning the Supreme Judicial Court and the Court of Common Pleas, 1840.
Concurrent jurisdictions and original jurisdictions remained the same, but the Supreme Judicial Court would have original jurisdiction in many, but not
all, real estate cases. The Court of Common Pleas would have jurisdiction of all cases not handled by Justices of the Peace. In cases where the
damages exceeded certain amounts, the defendant could ask to have the case removed to thee Supreme Judicial Court. No appeal was allowed from a jury
verdict, but certain procedural errors could be appealed. There were to be four justices in the Supreme Judicial Court. (Digitized from a microfilm copy
