Senate No. 42 On March 12, 1840 the Joint Standing Committee on the Militia reported a bill: An Act in addition to the several acts concerning the
militia, 1840. Every able-bodied white male resident in the Commonwealth ages 18-45, was to be enrolled in the militia, unless he opted out for $75.
The assessor was to keep a list of eligible males, pass it on to the county clerk, who was to pass it on to the Adjutant of the militia. Cases for
call-up were defined. The state would provide arms and equipment. The active militia's organization arrangement was listed; $5/year was base pay.
Three parades/year were required. Failure to appear meant a fine. Punishments for various offenses were listed. There was a form included in the
