Senate No. 29 On February 21, 1840, the Committee on the Judiciary submitted a report: The law on proof of marriage required a witness, a
certificate, or an authenticated record. The ceremony had to have been performed by someone legally authorized to do so. Marshalling the proofs was often
difficult because of the passage of time and especially so for out of state unions. The Committee decided it was an evidence question and suggested
allowing evidence of co-habitation to be allowed. An Act relating to evidence of marriage, 1840. Whenever proof of marriage or divorce was needed in a
case, co-habitation or other circumstantial or presumptive evidence could be received as competent evidence for consideration. (Digitized from a
