House No. 17 On January 29, 1836, the committee to consider the codification of the common law issued a report: The common law ought to be digested
into a code so it could be understood by anyone. The committee gave a four page history of common law, which was mostly court decisions. Special
pleading was a technique that called for deep knowledge of common law and was complicated and pernicious. Special pleading had to be removed from the
practice of law in order to codify the common law. Such codification would remove the practice of establishing and following judicial precedents.
Examining common law and retaining only the good parts in statutes would simplify everyone's life. Resolve: providing for the codification of the
common law, 1836. The Governor would appoint three people to digest and revise the common law into a code like the Revised Statutes. (Digitized from a
