SEE ALSO 52848 Senate No. 69 Mr. Williams moved to strike out all but the enacting clause of the bill abolishing special pleadings and substituted: parties were not held to the rules of common law re pleading. The defense could make a brief statement of its arguments and the plaintiff could summarize it claims. If there were a motion for written interrogatories, that supplied the issues for the jury to try. All special demurrers were abolished. A variance would only be allowed to correct a mistake.
