Williams. Amendment to the bill on special pleading, 1836
SEE ALSO 52848 Senate No. 69 Mr. Williams moved to strike out all but the enacting clause of the bill abolishing special pleadings and
substituted: parties were not held to the rules of common law re pleading. The defense could make a brief statement of its arguments and the plaintiff could
summarize it claims. If there were a motion for written interrogatories, that supplied the issues for the jury to try. All special demurrers were
abolished. A variance would only be allowed to correct a mistake. (Digitized from a microfilm copy of title originally held by the Massachusetts State
