Senate No. 39 On February 2, 1836, the Committee on the Judiciary submitted a bill in response to an order: An Act to abolish special pleading in
civil actions, 1836. All evidence would be given under the general issue of a case. The courts were to develop rules about notice to opposing
parties about evidence to be presented so all could prepare adequately for trial. (Digitized from a microfilm copy of title originally held by the

Ordered, that the Committee on the Judiciary, be instructed to consider the expediency of abolishing special pleadings in the trial of civil actions, and allowing special matter to be given in evidence under the general issue.
