Senate No. 20 On February 9, 1835 the Committee on the Judiciary provided a new draft of An Act to incorporate the Berkshire Mutual Fire Insurance Company, 1835. Three men were incorporated as above with the usual powers and privileges, and the company could be taxed. They were to select officers and have a meeting. When the corporation had $50,000 in hand, it could insure buildings anywhere in the Commonwealth. It could invest its funds and pay out expenses and fire losses of insured. In some situations, the directors might be personally liable for some funds. A policy was a lien on the property of the insured in case premium payments lapsed. The Committee on the Judiciary, to whom was referred a bill to incorporate the Berkshire Mutual Fire Insurance Company, have considered the same, and report it as taken into a new draft.
