House No. 59 The Committee on the Judiciary reported An Act in further addition to an act to incorporate the Massachusetts Horticultural Society,
1834. Anyone who willfully defaced any tombstone or grave furnishings or any plant or shrub in the Mount Auburn Cemetery was liable for a fine and/or
prison time and the cost of repairs. Anyone who owned a plot in the Cemetery was also a member of the Society and entitled to vote in the meetings.
The Society could accept gifts or grants and had the final say in cemetery improvements. There was no property tax on the cemetery. (Digitized from a
