House No. 55 An Act for defining the rights and duties of rail road corporations in certain cases, 1833. If a rail road was unable to obtain land
through negotiation with a land owner, it could apply to the local County Commission for a taking. The rail road had to be willing to give security
for the estimated costs. If either the land owner or the railroad held out for a jury finding, then that party had to pay all costs for the jury.
Turnpike owners had to be willing to work with rail roads on junctions. Rail roads had to keep local jurisdictions apprised of changes to the route.
