Senate. Comm. on Petition of M. Arms. Act to authorize probate courts to allow claimants to sue insolvent estates, 1833
Senate No. 33 On February 23, 1833, a bill was presented: An Act to authorize the Courts of Probate to grant leave to claimants upon insolvent
estates to institute suits in certain cases, 1833. If the claimant missed the early cut-off date for filing against an estate, the claimant could
petition a probate judge to allow the claim. If the executor was negligent or refused to pay the claim, the judge could allow the claimant to sue. If there
was not enough left to pay the claim in full, the claimant had to accept what there was. Any such claim had to be filed within four years of death.
