House. Comm. on Capital Punishment. Report on 1831 report, 1832
House No. 3 On June 21, 1831, the Committee on Capital Punishment referred the issue to the next legislative session and in the meantime authorized
William Sullivan to draw up three bills for the next session. On January 9, 1832, Sullivan presented his bills. A for no death penalty, B for
sometimes, and C to define the process of execution. An Act to abolish the punishment of death, 1832. Treason was excepted. The criminal was kept in
solitary for a year and then on hard labor for the rest of his/her life. An Act to abolish the punishment of death in certain cases, 1832. Arson,
burglary, robbery, and rape were no longer punishable by death but by solitary confinement for one year and hard labor thereafter. An Act to regulate
punishment by death, 1832. For any death sentence, the Sheriff was to build a space in a prison for the execution and viewing by 50 grand jurors and a few
magistrates, but no others. When the sentence was complete, the Sheriff was to fly a black flag over the building for an hour. (Digitized from a

Title:   The Committee to whom was referred a "Report on the punishment of death," have carefully examined and considered the same : and being deeply impressed with the great importance of the subject to the well being of society, and of the propriety of the greatest deliberation and caution in changing a mode of punishment, which has been so long and so generally in use, they regret that the shortness of the time allotted to the continuance of the present Session of the General Court, for­bids the attempt to accomplish that change, which they are unanimously of opinion ought to be made in the criminal laws of this Commonwealth at this time : they therefore report ...
