SEE ALSO 52233 Senate No. 23 A Select Joint Committee of two Senators and three Representatives presented a Report relating to the enclosure of
Cambridge Commons. Dated February 21, 1832, it said one person and four towns petitioned for the repeal of the Act of 1830 authorizing the enclosure of
Cambridge Common, followed by remonstrances of two groups and the Selectmen of Cambridge. Report: The Committee had hearings and took testimony
from many parties.
It presented a history of Cambridge Common which had been undivided and unenclosed until 1830, at which time eight and one half
acres were enclosed. There followed a discussion of all the roads and paths through the Commons, as well as a discussion of the Act and its aftermath.
The petitioners insisted there was collusion and nefarious behavior by those working under authority of the Act and, besides, the Act was
unconstitutional. The petitioners asked that jurisdiction over the Commons be restored to the County Commissioners. The Committee said if this was a
constitutional question, the Legislature was not the correct venue; the petition should be sent to the Supreme Judicial Court. The Committee said no further
