House No. 59 On February 26, 1831, the Committee on the Judiciary sent down a bill from the Senate: An Act to authorize and empower the County
Commissioners for the counties of Middlesex and Essex to lay out the Andover and Medford [turnpike] and the Essex Turnpike and establish them as county
roads, 1831. The Committee objected to the bill because it appeared the turnpike owners wanted to divest themselves of the roads, but to be paid for the
construction expenses they had made. The counties expected to tax the towns along the way to pay the developers. The Committee questioned the
constitutionality of that approach and said it was a bad bill. (Digitized from a microfilm copy of title originally held by the Massachusetts State
