House No. 33 On January 28, 1831, the Committee on the Judiciary was asked to consider whether in cases of jury trial for damages caused by roads,
canals, etc. the jury should be managed by a deputy sheriff or the real sheriff with powers like unto the Court of Common Pleas. The Committee thought
the real sheriff should definitely be the person in charge, but was uneasy with the idea of authority on the order of the Court of Common Pleas. It
reported out An Act concerning assessment of damages occasioned by the location of roads, railroads, canals, and flowage of lands, 1831. In all cases
where a jury would be called for such cases, the jury would be attended by a sheriff, not a deputy. (Digitized from a microfilm copy of title

Title:
Ordered, that the Committee on the Judiciary be instructed to consider the expediency of providing by law that in all cases relating to the assessment of damages by jury, occasioned by the location of roads, canals or railways, or flowage, it shall be the duty of the sheriff and not of his deputy, to summon and empannel the jury, and to preside at the trial, with all the authority and duties that the judges of the court of common pleas not have as to matters of law.
