Senate. Act authorizing construction of a canal from Northampton to the north line of this Commonwealth, 1828

Northampton to the north line of this Commonwealth, 1828. The Company was authorized to locate and construct a canal with locks, tow-paths, basins,
wharves, etc. ending at Northfield. It could build dams and reservoirs. It had to compensate for takings and damages. If it ran into serious obstacles,
the original route could be changed. It could collect tolls on boats, people, and cargo. There were one and one-half pages of tolls. The Company
could regulate the use of the canal, but had to post the regulations for everyone to see. There were penalties listed for vandalism on the waterway.
There were many pages of procedure for takings, damages, and payment estimates. The Company had to share water with the nearby land owners. Toll and
lock keepers had to be readily available 24 hours/day. There were directions for collecting tolls. The Company could begin to sell shares and were
admonished about record-keeping. If the canal was not completed in four years, the act was void. Once completed, it was a public waterway. On February
27, 1828, the bill was read and passed in the House. On February 29, 1828, the Senate offered amendments: the Legislature could regulate tolls and
annul some regulations and there were additional paragraphs about property damage and compensation. (Digitized from a microfilm copy of title
