H.R. 1 On January 3, 1827, the House Committee on Elections submitted its report. On June 17, 1826, the Committee had been asked to determine if anyone from the House could be called to the Council Board and if vacancies could be filled with methods other than called for in Chapter 6 of the Constitution. The Committee decided that yes, a House member could be called to the Council Board, but it was less clear about the vacancy issue and asked for clarification of both questions from the Supreme Judicial Court. The Court sent its letter on January 3, 1827. Yes, it was proper for a House member to be called to serve on the Council board, but that left a portion of the electorate without representation in the Legislature, so the Town or district thus underserved should hold an election to fill the vacancy.
