General Court. Act on prosecutions for libel and slander, 1824
|
|
In 1824, in a criminal libel case, the defendant may show the publication was with an honest intention. If the statements were true, then the libel was not mischievous. The jury may render a verdict based on fact or law, as they see fit. If a defendant pleads the libel is the truth, but can't prove it, do not automatically assume the libel was malicious.
