Thesis from the Judge Advocate General's School entitled "Due Process and Unavailable Evidence." Capt. Alan D. Chute, JAGC, United States Army
submitted the thesis in April 1987, which was subsequently published in 118 Military Law Review 93 (1987). This paper examined the military justices
treatment of cases where the government lost or destroyed potentially exculpatory evidence for the defense. The thesis reviewed the constitutional
standards and military rules; identified standards that the military courts should apply in various circumstances; and reviewed remedies available to courts
where the government had impermissibly destroyed or lost evidence.
