Cathey, Allowability of Interest in Defense Contracts: The Continuing Controversy, 1975
Thesis from the Judge Advocate General's Course entitled "The Allowability of Interest in Defense Contracts: The Continuing Controversy." Capt.
Theodore F.M. Cathey, JAGC, United States Army submitted the thesis in April 1975, which was published at 86 Military Law Review 3 (1979). The paper
traced the history of no-interest policy of the government from the doctrine of Sovereign immunity to Article IV of the Armed Services Procurement
Regulations. The central issue raised by this thesis was whether and when interest should be considered as a cost, concluding that it should be considered
as a cost of financing in equitable adjustments.
