Brewster, English Law of War, Rebellion & Capitulations, 1725
Jus feciale Anglicanum; Or a treatise on the laws of England relating to war and rebellion; With an account of the law of capitulations and
surrenders at mercy and discretion; To which is prefixed an expostulatory preface to the Right Honorable the Lord Parker, then Lord Chief Justice of England:
by Samuel Brewster, xxiv+55p, London, pr. for A. Moore, 1725. (A TOC follows the title page but one. Lacks index. Most of the text is in English, with
some Latin insertions. The preface to Lord Parker is not dedicatory in nature, but rather an extended protest at His Lordship’s declining to permit
the presentation of the author’s arguments in court. The strange word “fecilale” in the title is an incorrect variant of the Latin word “fetiales.” The
latter word refers to a Roman college of priests who had the duty of sanctioning treaties after conclusion. Thus, in this context, the phase refers to
the English law governing capitulations or surrenders. The print text of this title was scanned from Lincoln’s Inn Library pamphlet volume Hill 25.)
