DeHart, Observations on Military Law, 1859
Observations on Military Law, and the constitution and practice of courts martial; With a summary of the law of evidence as applicable to military
trials; Adapted to the laws, regulations and customs of the army and navy of the United States: by William C. De Hart, viii+433p + 4 p., NY, Wiley &
Halstead, 1859. (At the time of writing, De Hart was a captain of artillery. The index starts on p. 421. Since the pagination of this printing is the
same as that for an 1859 printing, also offered on this site, it is not clear that this is a different edition rather than a mere reprint. However this
copy may bear some separate interest if only due to the fact that it was the personal copy of Col. William E. Merrill, an important officer in the Army
Corps of Engineers in the post-Civil War period, who, at the time of his death of a heart attack at the early age of 56, was United States Engineer
in charge of the Ohio River and all of its navigable tributaries. Despite his day job, like all military officers Col. Merrill would have been
required to take his turn serving on courts-martial. The five blank pages appearing in this copy before the title page are filled with the engineer’s
conscientious notes on points of military law. The blank page following p. 433 provides possible evidence that the good coronel’s attention may have drifted
at some moment of tedium during a trial. This copy was gifted by the coronel’s widow to the University of Cincinnati, which in turn deposited it in
the Mid-West Inter-Library Center, predecessor to the Center for Research Libraries.)
